These Terms and Conditions ("Terms”) govern your use of the Digolo Hire platform, website, and services (collectively, the "Platform”) operated by Digolo Hire ("we”, "us”, or "our”), based in New South Wales, Australia. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
Digolo Hire is a third party intermediary platform. We provide the technology that enables Listers to list assets and accept bookings, and enables Hirers to search for and book those assets. While Digolo Hire facilitates the booking process and processes payments on behalf of Listers, we are not a party to the hire agreement itself. The hire agreement is formed solely and directly between the Lister and the Hirer.
Digolo Hire does not own, operate, inspect, or take possession of any asset listed on the Platform. Our role is strictly to provide the booking and payment infrastructure that connects Listers and Hirers. We do not supervise, endorse, or guarantee the conduct of any Lister or Hirer, or the quality, safety, or legality of any listed asset.
To the fullest extent permitted by law, Digolo Hire expressly excludes all liability of any kind arising out of or in connection with any hire transaction, even where Digolo Hire has facilitated the booking or processed the payment. This includes, without limitation:
The fact that Digolo Hire processes payments or facilitates bookings does not make us a party to the hire agreement, nor does it create any liability on our part for the outcome of that agreement. Digolo Hire is not liable regardless of whether loss or damage arises from negligence, breach of contract, or any other cause. Where liability cannot be excluded by law, our liability is limited to the maximum extent permitted under applicable Australian law.
Listers and Hirers each assume full and sole responsibility for their conduct, their assets, and their hire arrangements. Listers are solely responsible for ensuring their assets are safe, roadworthy, compliant with applicable laws, and adequately insured. Hirers are solely responsible for any loss, damage, or injury caused during the hire period. Digolo Hire strongly recommends all parties hold appropriate insurance before listing or hiring any asset through the Platform.
Digolo Hire is a peer-to-peer asset hire marketplace that connects individuals and businesses who wish to hire out their assets ("Listers”) with individuals and businesses who wish to hire those assets ("Hirers”). Digolo Hire provides booking management and payment processing services to facilitate these transactions, but acts solely as a third party intermediary and is not a party to any hire agreement.
To use the Platform, you must be at least 18 years of age, a resident of Australia, and capable of entering into a legally binding agreement. By registering an account, you confirm that all information you provide is accurate and up to date.
You are responsible for maintaining the confidentiality of your account login credentials and for all activity that occurs under your account. You must notify us immediately if you suspect any unauthorised access. Digolo Hire reserves the right to suspend or terminate accounts that violate these Terms.
Listers are responsible for ensuring all listing information is accurate, complete, and not misleading. Listers must own or have the legal right to hire out the listed asset, and must ensure it is in safe, working condition and complies with all applicable Australian laws. Digolo Hire reserves the right to remove any listing at its discretion without notice.
When a Hirer submits a booking request through the Platform, a booking is confirmed once accepted by the Lister or automatically confirmed in accordance with the Lister’s settings. Upon confirmation, a hire agreement is formed directly between the Lister and the Hirer. Digolo Hire facilitates this process but is not a party to the resulting agreement and has no obligations under it.
Digolo Hire processes payments on behalf of Listers as a third party payment facilitator. Hire fees are charged to the Hirer at the time of booking confirmation. Digolo Hire may charge a service fee to Listers, Hirers, or both, as displayed on the Platform at the time of booking. All fees are in Australian dollars (AUD) and inclusive of GST where applicable. Funds are held and disbursed to Listers in accordance with Digolo Hire’s payment schedule, less any applicable service fees.
Cancellation and refund policies are set by individual Listers and displayed at the time of booking. Where a cancellation qualifies for a refund under the applicable policy, Digolo Hire will process the refund to the original payment method. Digolo Hire service fees may be non-refundable. In the event of a dispute regarding a cancellation or refund, Digolo Hire may assist in mediation at its sole discretion but accepts no liability for the outcome.
Digolo Hire does not provide insurance for any asset listed or hired through the Platform. It is the sole responsibility of Listers and Hirers to arrange appropriate insurance. Digolo Hire accepts no liability for any loss, damage, injury, or claim arising from an uninsured or underinsured asset.
You must not use the Platform to list or hire assets that are illegal, stolen, unregistered, or unsafe. You must not engage in fraudulent, misleading, or deceptive conduct. You must not use the Platform in any way that violates applicable Australian law.
All content on the Platform is owned by or licensed to Digolo Hire and is protected by Australian intellectual property laws. You may not reproduce or distribute any Platform content without our express written consent.
Your use of the Platform is governed by our Privacy Policy, incorporated into these Terms by reference.
In the event of a dispute between a Lister and a Hirer, the parties must first attempt to resolve the matter directly and in good faith. Digolo Hire is not obligated to intervene or accept liability for the outcome of any dispute. These Terms are governed by the laws of New South Wales, Australia, and both parties submit to the non-exclusive jurisdiction of the courts of NSW.
Digolo Hire reserves the right to update these Terms at any time. Continued use of the Platform after changes are published constitutes acceptance of the updated Terms.
